This Data Policy outlines how Toshniwal Advisory Services Private Limited ("TAS") collects, stores, processes, and protects the data uploaded or stored by both Users (including NGOs, organizations, and individual users) on the TAS platform. By using the platform, you (“User” or “Data Provider”) agree to the following terms.
1. Scope of the Data Policy
1.1. This policy applies to all data, content, and information uploaded by NGOs, individual users, and any other parties (collectively referred to as "Users") on the TAS platform.
1.2. Data refers to any form of information uploaded, stored, or shared on the platform, including but not limited to personal information, contact details, financial data, project information, text, images, videos, reports, and any other materials.
2. Data Collection and Ownership
2.1. User Data: TAS collects and processes data provided by Users, including account registration information (name, email address, phone number), usage data, and any content uploaded to the platform (e.g., project descriptions, media, and reports).
2.2. NGO Data: NGOs are responsible for uploading their own data, including organizational details, financial information, and operational reports. NGOs retain ownership of the data they upload.
2.3. Personal Data: For individual Users, TAS collects personal data required for account creation, communication, and service provision. Personal data will be processed in compliance with applicable privacy laws and regulations.
3. Data Usage
3.1. Operational Purpose: TAS will use the data uploaded by Users and NGOs solely for the operation and maintenance of the platform, providing services to NGOs and facilitating user interaction with NGOs.
3.2. Public Availability: By uploading data, Users and NGOs understand that certain parts of their data (such as organizational profiles, project details, and impact reports) may be visible to the public or other Users on the platform.
3.3. Analytics: TAS may aggregate and anonymize data for internal analytics, operational improvements, and reporting without revealing the identities of individual Users or NGOs.
3.4. Third-Party Services: TAS may share data with trusted third-party service providers to help operate the platform (e.g., web hosting, cloud storage). These third-party providers are contractually obligated to maintain the confidentiality and security of the data they access.
4. User and NGO Responsibilities
4.1. Accuracy of Data: Users, including NGOs, are solely responsible for ensuring the accuracy, legality, and integrity of the data they upload to the platform. TAS does not verify or authenticate the content uploaded by Users or NGOs.
4.2. Compliance: Users must ensure that all data uploaded complies with relevant laws, regulations, and ethical standards. Illegal, harmful, or infringing content is prohibited.
4.3. Third-Party Data: Users are responsible for obtaining necessary permissions if their uploaded data includes third-party content or personal information.
5. Data Protection and Security
5.1. Security Measures: TAS employs commercially reasonable measures to protect the data stored on the platform, including encryption, secure servers, firewalls, and restricted access protocols.
5.2. Hosting on Third-Party Servers: Data uploaded to the TAS platform may be stored and processed on third-party servers and cloud hosting services. While TAS selects reputable third-party service providers with robust security practices, TAS cannot guarantee the absolute security of these third-party environments. Users acknowledge and accept the risks associated with third-party data storage.
5.3. Security Limitations: Despite our efforts, no system is fully secure. Users acknowledge that uploading data involves inherent risks, and TAS cannot guarantee the complete security of the data.
5.4. User Responsibility: Users and NGOs are responsible for protecting their login credentials and ensuring that their accounts are secure. Any unauthorized access due to User negligence is the responsibility of the User.
6. Indemnification and Liability
6.1. Indemnity by Users: Users, including NGOs, agree to indemnify, defend, and hold harmless TAS, its officers, employees, and agents from any claims, liabilities, losses, damages, or costs arising out of:
- a. The User’s violation of this Data Policy;
- b. The User’s violation of any applicable laws or regulations;
- c. The User’s uploaded content, including any claims of intellectual property infringement, defamation, or privacy violations.
6.2. No Liability for Data Breaches: TAS will not be held responsible for any unauthorized access, loss, or damage to data due to hacking, breaches, or security incidents that are beyond our control, including those affecting third-party servers. Users and NGOs acknowledge and accept the inherent risks of data transmission and storage.
6.3. Limitation of Liability: In no event shall TAS be liable for any indirect, incidental, punitive, or consequential damages arising out of the use or handling of data, including loss of data, corruption, or unauthorized access.
7. Data Retention and Deletion
7.1. Data Retention: TAS will retain User and NGO data for as long as necessary to fulfill the purposes for which the data was collected, or as required by applicable law. If the data is no longer needed, it may be archived or deleted.
7.2. Data Deletion: Users and NGOs can request the deletion of their data by contacting TAS. TAS will make commercially reasonable efforts to remove or anonymize the data, except where retention is required for legal or regulatory purposes.
8. Data Breach Notification
8.1. Notification Obligation: In the event of a data breach that compromises the security of User or NGO data, TAS will notify affected parties without undue delay, in compliance with applicable laws.
8.2. Mitigation Efforts: TAS will take reasonable steps to investigate and mitigate the effects of any data breach, although TAS disclaims liability for damages resulting from breaches not attributable to TAS’s negligence.
9. User Rights
9.1. Access: Users and NGOs have the right to access their data and request corrections or updates to their information at any time.
9.2. Consent Withdrawal: Users and NGOs can withdraw their consent to data processing at any time by deleting their accounts or contacting TAS to request data removal.
9.3. Data Portability: Upon request, Users and NGOs may receive a copy of their data in a structured, machine-readable format, where technically feasible.
10. Cookie Usage
10.1. TAS uses cookies to enhance user experience, store user preferences, and gather analytical data. Users can manage or disable cookies through their browser settings, though this may affect the platform's functionality.
11. Third-Party Access
11.1. Third-Party Services: The platform may provide access to or integrate with third-party services, such as donation gateways or external links. These third-party services operate under their own terms and policies, and TAS is not responsible for their actions or data practices.
11.2. Third-Party Data: TAS may provide access to User or NGO data to trusted third-party service providers who are necessary for operating the platform. TAS will ensure that these third parties uphold data protection obligations similar to those in this policy.
12. Changes to the Data Policy
12.1. TAS reserves the right to update or amend this Data Policy at any time. Any changes will be posted on the platform, and Users will be notified of significant updates.
12.2. Continued use of the platform after such changes have been made constitutes acceptance of the revised policy.
13. Governing Law
13.1. This Data Policy is governed by and construed in accordance with the laws of [Insert Jurisdiction], and any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts of Navi Mumbai, India.
